Minority Leader Alexander Afenyo-Markin has filed fresh defamation lawsuits at the Accra High Court against Ghana Gold Board (GoldBod) Chief Executive Officer Sammy Gyamfi and National Entrepreneurship and Innovation Programme (NEIP) Chief Executive Officer Eric Adjei.
The fresh lawsuits follow earlier legal proceedings involving the two officials over statements allegedly made about the Minority Leader. Afenyo-Markin is seeking to pursue his claims through the courts after developments in the previous cases.
The legal action has attracted attention because it involves prominent public officials and allegations arising from public discussions and media appearances.
Afenyo-Markin’s Dispute With Sammy Gyamfi
The legal dispute between Afenyo-Markin and Sammy Gyamfi is linked to public discussions about the financial performance of the Bank of Ghana’s Domestic Gold Purchase Programme.
Afenyo-Markin had raised concerns about reported financial losses associated with the programme and called for accountability regarding its operations.
Gyamfi, who heads GoldBod, responded to the Minority Leader’s criticisms during public discussions, including the Government Accountability Series and Joy FM’s Newsfile programme.
During the exchanges, Gyamfi allegedly described Afenyo-Markin as an “extortionist”. The Minority Leader considered the remark defamatory and initiated legal proceedings against him.
However, the earlier lawsuit encountered a procedural setback when the Accra High Court set aside the writ of summons and statement of claim.
The court’s decision concerned the legal requirements for filing the case. It did not determine whether the alleged statement was defamatory.
Afenyo-Markin has now filed a fresh writ to pursue the matter through the court system.
Fresh Legal Action Against Eric Adjei
Afenyo-Markin has also filed a fresh defamation lawsuit against Eric Adjei, the Chief Executive Officer of the National Entrepreneurship and Innovation Programme.
The case concerns statements Adjei allegedly made about the Minority Leader during an appearance on Peace FM.
Before the fresh High Court action, an earlier case against Adjei at the Achimota Circuit Court was withdrawn. Reports indicated that discussions had taken place about the possibility of resolving the dispute amicably.
Adjei’s lawyer, Gideon Koku Abotsi, reportedly indicated that efforts had been made to explore an out-of-court settlement.
The subsequent filing at the Accra High Court shows that Afenyo-Markin intends to continue pursuing his claims through legal proceedings.
The fresh case will allow the parties to present their respective positions in accordance with the court’s procedures.
What Led to the Fresh Lawsuits?
The latest actions follow separate developments in the earlier cases.
In the matter involving Gyamfi, the previous writ was set aside over procedural requirements. Afenyo-Markin subsequently initiated a fresh action.
In the case involving Adjei, the earlier proceedings at the Achimota Circuit Court were withdrawn before the fresh High Court filing.
These developments mean that the legal disputes are continuing through new proceedings rather than ending with the earlier cases.
The next steps will depend on the court process and any decisions made by the judge handling the matters.
What the Cases Mean for the Parties
Defamation claims generally concern statements alleged to have harmed a person’s reputation. The court must consider the evidence, the arguments presented by both sides and the applicable law before determining liability.
For Afenyo-Markin, the fresh lawsuits provide another opportunity to pursue his complaints through the judiciary.
For Gyamfi and Adjei, the proceedings provide an opportunity to respond to the allegations and present their positions before the court.
It is important to note that the filing of a lawsuit does not establish that the alleged statements were defamatory. The claims remain subject to the legal process and any eventual court determination.
The cases have also renewed public attention on the responsibilities that accompany public commentary, particularly when disagreements involve public officials and matters of national interest.
Minority Leader Alexander Afenyo-Markin has filed fresh defamation lawsuits against Sammy Gyamfi and Eric Adjei at the Accra High Court following earlier legal proceedings.
The action against Gyamfi follows the setting aside of an earlier writ over procedural issues, while the fresh case against Adjei comes after an earlier suit at the Achimota Circuit Court was withdrawn.
Both cases remain subject to the judicial process. Further developments will depend on the proceedings and the decisions of the court.
