Supreme Court Dismisses Oppong Nkrumah Injunction Application

The apex court has officially thrown out the injunction application filed by the Member of Parliament for Ofoase Ayirebi, Kojo Oppong Nkrumah.

The legal battle started when the Chief Justice issued a directive allowing selected judges to sit and hear specific criminal matters during the legal vacation.

Oppong Nkrumah quickly filed a writ arguing that prioritizing some criminal cases while leaving others creates selective justice and violates equal rights.

He pointed out that forcing judicial staff to work without proper rest breaches constitutional provisions on fair working conditions and health.

The court panel considered the arguments presented by the applicant alongside the submissions from the Attorney General representing the state.

Judges ruled that the application lacked strong legal grounds to stop the Chief Justice from exercising discretionary powers to manage court schedules.

The dismissal means courts listed for special vacation sittings will continue hearing their assigned criminal cases without any interruption.

Lawyers across the country are closely watching the decision, as it sets a major precedent for administrative powers within the Judiciary of Ghana.
