The trial of former National Signals Bureau Director General Kwabena Adu-Boahene and his wife Angela Adjei Boateng took a dramatic turn at the High Court in Accra on Tuesday August 11, 2026.
Presiding judge Justice Francis Apangabonu Achibonga gave the accused couple a six day ultimatum to secure their defense team or face cross-examining the fourth prosecution witness by themselves.
The directive followed proceedings where the couple appeared in court without their legal team, led by Samuel Atta Akyea.
The defense team had earlier written to the Chief Justice indicating their decision not to participate in court proceedings during the ongoing legal vacation.
Addressing the court, Adu-Boahene explained that reaching his lead counsel proved difficult because several team members were involved in script marking assignments outside Accra while others were likely out of the jurisdiction.
He appealed to the trial judge to grant them time to resolve the communication breakdown with their legal representatives.
Deputy Attorney General Dr Justice Srem-Sai strongly opposed postponing proceedings simply because defense lawyers chose not to attend during the vacation period.
Dr Srem-Sai submitted that only presiding judges holding valid warrants from the Chief Justice hold the legal authority to determine court sittings, arguing that lawyers cannot decide on their own when court business happens.
Justice Achibonga ruled that while the letters written to the Chief Justice by defense counsel and the Ghana Bar Association do not stay court proceedings, fairness requires giving the accused persons reasonable time to organize legal representation.
The court adjourned the case to August 17, warning that if counsel fails to show up on the next date, the accused persons must conduct the cross-examination themselves or see the prosecution witness discharged.
Adu-Boahene, Angela Adjei Boateng, and Advantage Solutions face 11 criminal counts, including allegations of stealing GH¢49.1 million meant for a national cyber security defence system. All accused persons maintain their innocence and remain on bail.
