Suspects can legally sue the Ghana Police Service if officers detain them beyond the 48-hour constitutional limit. Supreme Court Judge Justice Edward Asante delivered this clear warning to remind law enforcement that human rights are non-negotiable in Ghana.
Article 14 Section 3 of the 1992 Constitution requires police to present any arrested person in court within 48 hours. If the period expires without court appearance, the detention immediately turns into an unlawful action under Ghanaian law.
Police officers often cite pending investigations to justify keeping suspects longer in cell. However, Justice Asante emphasized that administrative delays inside police stations do not override citizens’ rights guaranteed by the fundamental law of the land.
Victims of illegal police custody have full legal right to file civil suits against the State. The courts can award monetary compensation to affected individuals for unlawful arrest, illegal detention, and fundamental rights violation.
Such legal actions also compel public institutions to maintain strict professional standards. Knowing your rights stops abuse of power, because keeping someone in a cell without court order comes with expensive legal consequences for the State.
Judicial interventions like this strengthen democratic governance and rule of law across the country. Citizens must understand their constitutional rights, while police commanders ensure officers process suspects quickly or release them on bail.
Respecting constitutional timelines creates genuine trust between citizens and state security apparatus. Following the law strictly ensures safety while protecting innocent people from prolonged, unlawful detention in Ghana.
